This Privacy Policy (the “Policy”) describes how LAUGO ARMS USAA, LLC, and its subsidiaries and corporate affiliates (collectively “we”, “us”, “our”, “Laugo Arms USA”, or “LAUGO ARMS USA, LLC”) collect and use personal information when you use, visit, access, or respond to our website https://laugoarmsusa.com/ (the “Website”). This Policy covers information we may collect from you or that you provide to us in connection with the Website, as well as any online applications, mobile applications, emails, telephone inquiries, sweepstakes, contest and rebate submissions, product and warranty registrations, newsletters, forums, posts, comments, surveys, and the like, and the websites and applications maintained and operated by our third-party contractors (collectively, the “Services”), and describes our policies and practices regarding the collection, disclosure, use, storage, and protection of the information we collect. This Policy does not apply to websites operated by third parties, even if those websites are accessible from links on the Website.

Please read this Policy carefully in its entirety. By visiting, accessing, or using the Website, you acknowledge that you have read and understand this Policy and agree to it. If you do not agree with this Policy, or any aspect of it, please do not visit, access, or use the Website. The Website is not intended for use by individuals located in the European Union (EU) or European Economic Area (EEA). We do not collect or track personally identifiable information (defined below) from individuals in the EU or EEA.

Please note that special terms and conditions apply to individuals who are residents of the states of California or Virginia as indicated in this Policy. As a result, certain provisions of this Policy may not apply to you.

This Policy may be updated, revised, or changed at any time at our discretion without notice to you. The current Policy in effect will be accessible on the Website. You agree to periodically review the Website for updates, revisions, or changes to the Policy. By continuing to visit, use or access the Website, you agree to any updates, revisions, or changes to the Policy.

INFORMATION WE COLLECT

A. Information You Provide to Us

To use certain areas and features of the Website, we may require you to provide us with information that identifies you personally (we refer to such information as “personal information” or “personally identifiable information” in this Policy). We collect information from you when you provide it to us in response to a request for such information and automatically by means which are part of the applications needed to provide the Services to you.

In the last 12 months, personal information we have collected may include your:

  • Company name,
  • Mailing and billing addresses,

  • Phone numbers,
  • Zip codes,
  • Financial information (such as credit card or bank information),
  • Repair records,
  • Firearm serial number(s), and
  • Organization membership (such as a member of the military or law enforcement).

We may also collect other information that you submit in connection with our Services, including product reviews, sweepstakes or contest entries, consumer rebate submissions, product or warranty registration, and other similar information. Information obtained automatically through application usage consists primarily of anonymous usage statistics, but also includes “Cookies” (as defined below).

B. Information Collected Automatically

We may, directly or indirectly (through a third party), collect internet or electronic network activity about you and your use of our Services whenever you use the Services.  For example, in the last 12 months, we may have automatically collected information about your:

  • IP address,
  • Your user behavior (e.g., click activity), and
  • Website analytics.

This data generally does not personally identify you and is automatically collected (as third-party Cookies) when you use our Services. This anonymized information is helpful for marketing purposes and improving our Services.

  • For administrative purposes,
  • To bill you for a service offered by the Website,
  • To correspond with you regarding a request, inquiry, or purchase you have made,

  • To provide customer support,
  • To maintain and improve the Services, and
  • To otherwise correspond with you (such as through email or correspondence to us at your request and with your consent).

You may provide this information to us by filling out forms on the Website, creating an account, making purchases, entering contests or promotions, or by similar methods or means.

  • To third parties (e.g., vendors and hosting companies) to provide the software, hardware, storage, networking, and other necessary technology required to provide high quality products and services to you through the Website.
  • To fulfill the purpose or purposes for which you provided the personal information.
  • For any other lawful or legitimate purposes, including, with your consent, where applicable.
  • To comply with any lawful process or court order, cooperate with law enforcement, and to otherwise comply with any applicable laws or regulations.
  • With your consent for a specific purpose that is not compatible with the purposes listed here.

We will never sell your personal information to any third parties and do not share your personal information with third parties for direct marketing purposes.

We may share some information with Mailchimp and QuickBooks, including your full name, email address, and transaction details. Mailchimp and QuickBooks are Intuit products. HOW WE ENSURE THE SECURITY OF YOUR INFORMATION

Laugo Arms USA is committed to ensuring that your personal information is secure. We have put in place appropriate physical, electronic, and managerial procedures to prevent unauthorized access, modification, disclosure, or loss of your personal information. However, we cannot guarantee your personal information will never be disclosed in a nature that conflicts with this Policy. Additionally, we are not responsible for any breach of security or actions undertaken by any third parties that receive the information. The security measures are revised on an ongoing basis in accordance with technological development and commercially acceptable means for protecting personal information.

HOW WE STORE INFORMATION

Laugo Arms USA retains all rights of ownership related to the software, code, databases, designs, and any other internally developed application to provide the Website and Services. You retain all rights of your data posted on the Website.  We utilize external vendors and hosting companies to provide the software, hardware, storage, networking, and other necessary technology required to provide the Services. All information gathered by or provided to us, including but not limited to your personally identifiable and non-identifiable personal information, is stored in the United States of America. All information stored by Laugo Arms USA is subject to the laws of the United States of America, regardless of the country from which the data originates.

HOW LONG WE KEEP YOUR INFORMATION

We will retain your personal information as long as necessary for the fulfillment of the purposes contained in this Policy, in accordance with our records retention policies, and in accordance with applicable laws and regulations. Notwithstanding the foregoing, we will retain your personal information for longer periods for specific purposes to the extent that we are obliged to do so in order to comply with applicable laws and regulations, court orders, and/or as necessary to protect our legal rights or for certain business requirements. For example, when we process your payments, we will retain this data for longer periods of time as required for tax or accounting purposes. More specifically, we will retain some information for longer periods of time for the following reasons:

  • Security, fraud & abuse prevention.
  • Financial record-keeping.
  • Complying with legal or regulatory requirements.
  • Direct communications with us.

RIGHTS TO YOUR INFORMATION

A. Access, Correct, or Delete Your Information

We make every effort to give you access to your personal information, to allow you to correct any inaccuracies, or to delete your personal information at your request, provided it is not required to be retained for genuine business purposes or by law.

Please include your full name, mailing address, and email address when you contact us. You must describe the information that you want to access, correct, delete, or modify in sufficient detail to allow us to locate that information in our records.

Upon receipt of a Verifiable Consumer Request, we will provide you with information regarding:

  • Categories of personal information collected about you, including the sources of the information.
  • The business or commercial purpose for collecting your personal information.
  • Identification of the personal information collected.

We may refuse requests that are of unreasonable technical effort or would be highly unfeasible, endanger the privacy of others, or require access that is not normally necessary.  When we provide access to your personal information for the purposes of modification, correction, or deletion, we do so free of charge except where doing so requires an unreasonable effort. Please note that a request to remove or delete information may prevent us from providing certain products or services to you. We will not remove or modify information associated with your prior purchase or registration of a product.

B. Do Not Track

We do not respond to “Do Not Track” requests received from your web browser.

RIGHTS OF CALIFORNIA CONSUMERS

If you are a resident of the state California (a “California Consumer”), the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) and applicable implementing regulations (collectively the “CCPA”) provides you with specific rights regarding the collection, use, correction, deletion, transfer, and processing of your “Personal Information” and “Sensitive Personal Information”, as those terms are defined under the CCPA. Any capitalized terms not otherwise defined in this Section of the Policy shall have the same meaning given to them in the CCPA. We reserve the right to limit these rights where permitted under applicable law, including where your identity cannot be reasonably verified or to the extent your rights adversely affect the rights and freedoms of others.

This section describes the rights of California Consumers under the CCPA and explains how to exercise those rights. During any given 12-month period, we may gather Personal Information from the categories listed below and will disclose these categories of Personal Information to a California Consumer upon receipt of a Verifiable Consumer Request. To make a Verifiable Consumer Request, please contact us via the information below. Only you or a person that you authorize to act on your behalf may make a Verifiable Consumer Request related to your Personal Information.

A. Our Collection and Use of Personal Information

You have the Right to Know what Personal Information we may have collected about you within any given 12-month period. As a general matter, within the 12-month period preceding the last update of this Policy, we may have collected the following categories of Personal Information about you:

  • Identifiers, such as your first and last name, email address, IP address, or Cookies,
  • Online Activity, such as your browsing or search history and interaction with our Website,
  • Customer Records Information, such as repair records, firearm serial number(s), and organization membership, and
  • Financial Information, such as credit or debit information, or any other payment information you provide us.

This information may be used for any purposes indicated on our Website and for the following business purposes as specified in the CCPA:

  • To verify your identity,
  • To fulfill orders and process transactions and payments,
  • To communicate with and provide information to you,
  • To better understand how our visitors use and interact with our Website and Services,
  • To enhance the online experience of our visitors,
  • For administrative purposes and analytics,
  • To detect and resolve security threats, protect against malicious, deceptive, fraudulent, or illegal activity, and associated legal prosecution, and
  • To identify and repair errors that may impair website functionality and experience.

We do not collect any Personal Information that would be considered Sensitive Personal Information under the CCPA.

In the preceding twelve (12) months as of the last update to this Policy, we have not sold any consumer Personal Information, including, but is not limited to, Personal Information of minors under sixteen (16) years of age.

B. Our Disclosure of Personal Information

In the preceding twelve (12) months as of the last update to this Policy, we may have disclosed your Personal Information to the following third party service providers to fulfill the business purposes outlined above:

  • Vendors, consultants, and others who provide Services to you on our behalf, and
  • Data analytics providers, data marketing service providers, and web analytics providers.

In addition to the above, we may also share your Personal Information as required pursuant to applicable governmental entity and law enforcement requests, or as otherwise may be required pursuant to applicable law or regulation.

C. Individual Rights of California Consumers

(i) Right to Request Access to Personal Information

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months.  Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of Personal Information we collected about you in the preceding 12 months,
  • The categories of sources for the Personal Information we collected about you,
  • Our business or commercial purpose for collecting or selling that Personal Information,
  • The categories of third parties with whom we share that Personal Information,
  • The categories of Personal Information that we sold in the previous 12 months, and for each category identified, the categories of third parties to which it sold that particular category of Personal Information (please note, Laugo Arms USA does not sell personal information), and
  • The specific pieces of Personal Information we collected about you (also called a data portability request).

If we disclosed your Personal Information for a business purpose, we will disclose to you the Personal Information categories that the recipient obtained.

(ii) Right to Request Deletion of Personal Information

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions.  Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.  We shall inform the you whether or not we have complied with the your request. 

We may deny your deletion request if retaining the Personal Information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may seriously impair the research’s achievement or render it impossible.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

(iii) Right to Request Correction of Personal Information

You have the right to request that we correct any inaccurate Personal Information that we collected from you and retained, subject to certain exceptions.  Once we receive, verify, and approve your request, we will correct (and direct our service providers to correct) your Personal Information, unless an exception applies.  We shall inform you whether or not we have complied with your request.

(iv) Right to Opt-Out of Sharing of Personal Information

You have the right to opt out of the sharing of your Personal Information to a third party for data analytics.  Laugo Arms USA does not sell your Personal Information. We share some Personal Information with other companies, as described above.

(v) Exercising Right to Access, Correct, or Delete

To exercise the rights described above, please submit a Verifiable Consumer Request to us by either:

  • Submitting a request by emailing us at usa@laugoarms.com.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a Verifiable Consumer Request related to your Personal Information. You may also make a Verifiable Consumer Request on behalf of your minor child.

You may only make a Verifiable Consumer Request for access or data portability twice within a 12-month period. The Verifiable Consumer Request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative of that person, and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a Verifiable Consumer Request does not require you to create an account with us. We will only use Personal Information provided in a Verifiable Consumer Request to verify the requestor’s identity or authority to make the request. Under the CCPA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf.  We may request that your authorized agent have written permission from you to make requests on your behalf and may need to verify your authorized agent’s identity.

We will confirm receipt of a Verifiable Consumer Request within 10 business days and provide information about how the Request will be processed.  We will locate the requested Personal Information, and, if available, will take the requested action with regards to your Request.  We endeavor to respond to a Verifiable Consumer Request within forty-five (45) calendar days of its receipt.  We may deny a request if we cannot verify the consumer within the 45-day time period.  If we require more time (up to 90 calendar days), we will inform you of the reason and extension period in writing.  We will respond to a Verifiable Consumer Request in the same format in which the original Request was made.

Any disclosures we provide will only cover the 12-month period preceding receipt of the Verifiable Consumer Request.  The response we provide will also explain the reasons we cannot comply with a Request, if applicable.  For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your Verifiable Consumer Request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the Request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your Request.

RIGHTS OF VIRGINIA CONSUMERS

The Virginia Consumer Data Protection Act of 2022 and applicable implementing regulations (collectively the “VCDPA”) provides residents of Virginia (“Virginia Consumers”) with specific rights regarding their Personal Information. This Section describes the rights of Virginia Consumers under the VCDPA and explains how to exercise those rights. Any capitalized terms not otherwise defined in this Section of the Policy shall have the same meaning given to them in the VCDPA.

Virginia Consumers have the right to:

  • Confirm whether or not Laugo Arms USA processes their Personal Information;
  • Access any Personal Information processed by Laugo Arms USA;
  • Correct inaccuracies in the personal data processed by Laugo Arms USA;
  • Delete the personal data processed by Laugo Arms USA;
  • Obtain a copy of the personal data processed by Laugo Arms USA; and
  • Opt-out of the processing of the personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer (please note that Laugo Arms USA does not process any personal data for these purposes).

  • The categories of Personal Information we collected about you in the preceding 12 months,
  • The categories of sources for the Personal Information we collected about you,
  • Our business or commercial purpose for collecting or selling that Personal Information,
  • The categories of third parties with whom we share that Personal Information,
  • The categories of Personal Information that we sold in the previous 12 months, and for each category identified, the categories of third parties to which it sold that particular category of Personal Information (please note, Laugo Arms USA does not sell personal information), and
  • The specific pieces of Personal Information we collected about you (also called a data portability request).

If we disclosed your Personal Information for a business purpose, we will disclose to you the Personal Information categories that the recipient obtained.

You may exercise your right to obtain a copy of the Personal Information processed by us twice in a single 12-month period. If your request to obtain a copy of the Personal Information is verified and approved, we will provide the information free of charge no more than twice in a single 12 month period.

(ii) Right to Correct Inaccuracies in Personal Information

You have the right to request that we correct any inaccurate Personal Information that we collected from you and retained, subject to certain exceptions.  Once we receive, verify, and approve your request, we will correct (and direct our service providers to correct) your Personal Information, unless an exception applies.  We shall inform you whether or not we have complied with your request. 

(iii) Right to Delete Personal Information

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions.  Once we receive, verify, and approve your request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.  We shall inform you whether or not we have complied with your request. 

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech or exercise another right provided for by law.
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

(iv) Exercising Your Rights Pursuant to the VCDPA

To exercise the rights described above, please submit a Verifiable Consumer Request to us by either:

Only you may make a Verifiable Consumer Request related to your Personal Information.  You may also make a Verifiable Consumer Request on behalf of your minor child or an individual for whom you are the legal guardian.

You may only make a Verifiable Consumer Request for access or data portability twice within a 12-month period.  The Verifiable Consumer Request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.   

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a Verifiable Consumer Request does not require you to create an account with us. We will only use Personal Information provided in a Verifiable Consumer Request to verify the requestor’s identity or authority to make the request. NON-DISCRIMINATION

We will not discriminate against you for exercising any of your CCPA or VCDPA rights.  Unless permitted by the CCPA or VCDPA, we will not do any of the following based upon your decision to exercise your rights under the CCPA or VCDPA:

  • Deny you goods or services;
